Terms of Service

1. Scope of Work & Project Execution

  • Project Brief: All client engagements are defined by a written proposal, quote, or online checkout selection outlining specific technical deliverables.
  • Design Revisions: Custom design projects include up to two (2) rounds of major structural revisions during the mock-up stage. Additional revision requests or post-approval scope changes will be billed at standard hourly rates.
  • Content Delivery Schedule: Clients must supply required brand assets, translations, texts, and credentials within 14 calendar days of project kickoff. Delays in client content submission will pause project schedules without liability to AlKhowatir.

2. Payment Terms, Renewals & Account Suspension

  • Payment Schedules: Web development projects require a 50% non-refundable deposit before work commences, with the remaining 50% balance due upon staging approval prior to live deployment.
  • Recurring Services: Hosting, domain registrations, email licenses, and maintenance plans are billed on an annual or monthly subscription cycle.
  • Grace Period & Suspension: Invoices unpaid seven (7) days past their due date will incur a late warning. Services unpaid after fourteen (14) days are subject to automatic suspension. Suspended hosting and email accounts are permanently purged after 30 days of non-payment.

3. Acceptable Use Policy (AUP) & System Integrity

  • Prohibited Content: Hosting accounts and business email services may not be used for hosting illegal material, phishing, malware distribution, adult content, or unauthorized bulk mailing (SPAM).
  • Security & Account Safety: Clients are responsible for maintaining strong password hygiene for control-panel, CMS admin accounts, and business mailboxes. AlKhowatir reserves the right to isolate or disable any script or account actively compromised by malware to protect shared server stability.

4. NFC Hardware & Digital Profile License

  • Manufacturing Defect Warranty: Physical NFC cards carry a 90-day replacement warranty covering hardware chip defects or internal antenna failures under normal use. Warranty does not cover physical wear, snapping, or water damage outside IP rating specs.
  • Digital Profile Hosting: Active digital vCard routing for NFC cards requires an active AlKhowatir platform license, included with your initial package or annual hosting maintenance agreement.

5. Limitation of Liability

AlKhowatir Digital Solutions is not liable for indirect damages, lost business revenues, or data loss resulting from third-party infrastructure outages (e.g., cloud providers, ICANN domain disputes, global ISP fiber cuts), client unauthorized code edits, or delayed client asset submissions. Maximum aggregate financial liability shall not exceed the fees paid by the client for the specific service in the preceding 3 months.

6. Governing Law

These Terms of Service are governed by the laws of the Kingdom of Saudi Arabia.
